Petition For Urgent Institution Investigation

SUBJECT: URGENT ALLEGATION OF SUB-STANDARD DETENTION CONDITIONS AND ENVIRONMENTAL EXPOSURE OF MALAM NASIRU EL-RUFAI.

 

I. PREAMBLE.

This petition is filed to draw the attention of the international community to the deteriorating health and safety conditions under which Malam Nasiru El-Rufai, a high-profile political figure and former Governor of Kaduna State, is currently being held by the Independent Corrupt Practices and Other Related Offences Commission (ICPC) in Abuja, Nigeria.

 

II. VIOLATION OF THE NELSON MANDELA RULES.

The conditions of Malam El-Rufai’s detention at the ICPC headquarters constitute a direct violation of several key provisions of the United Nations Standard Minimum Rules for the Treatment of Prisoners (The Nelson Mandela Rules):

 

A. Rule 13 (Acommodations).

All accommodation provided for the use of prisoners shall meet all requirements of health, with due regard being paid to climatic conditions and particularly to cubic content of air, minimum floor space, lighting, heating and ventilation.

 

– The Breach.

The detainee is being held in a repurposed office building (formerly the NRC political headquarters) which lacks residential ventilation, proper sleeping quarters, and adequate sanitary facilities.

 

B. Rule 43 (Prohibition of Inhumane Treatment).

This rule prohibits the placement of a prisoner in a dark or constantly lit cell, and any form of soft torture.

 

– The Breach.

Keeping a detainee in an industrial office environment 24/7—where artificial light and industrial HVAC systems are not designed for circadian health—constitutes sensory and psychological distress.

 

C. Rule 58 (Contact with the Outside World).

Prisoners shall be allowed to communicate with their family and reputable friends at regular intervals.

 

– The Breach.

The requirement for the Chairman of the ICPC to personally screen every visitor, including legal counsel creates an arbitrary barrier that isolates the detainee from the outside world.

 

III. CRITICAL HEALTH AND SAFETY RISKS.

Evidence suggests that the ICPC building is structurally compromised and poses the following risks:

A. Environmental Toxins.

Potential exposure to legacy industrial hazards (asbestos, lead, or mold) in a building originally designed for 1990s-era political administrative use.

 

B. Medical Emergency Deficit.

As an office space, the facility lacks a 24-hour medical wing or the specialized emergency protocols required for a high-profile individual in a high-stress environment.

 

C. Arbitrary Restriction.

The refusal to allow weekend and holiday visits prevents independent monitoring of the detainee’s physical state during high-risk windows.

 

IV. PRAYERS / REQUEST FOR ACTION.

We urgently request that the United Nations and the International Community:

 

1. Mandate an Independent Inspection.

Demand that a neutral diplomatic or UN-led medical and architectural team be granted access to inspect the specific room where Malam El-Rufai is held.

 

2. Ensure Transfer to Certified Facility.

Direct that if detention must continue, the subject be moved to a certified remand facility that meets international health and safety standards.

 

3. Cease Selective Access.

Compel the ICPC to normalize access for lawyers and family without the personal intervention or instructions of political appointees.
